1. Introduction

Welcome to Draw You! by Getcovers OÜ (“Company”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of Draw You! (the “Game”), including any features, content, and services related to it. By accessing, downloading, or using the Game, you agree to comply with these Terms. If you do not agree, you must not use the Game. Your use of the Game is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. If you are under 18 years of age (or the age of majority in your jurisdiction), you may have limited access to certain features to ensure a safe environment. We may update these Terms to reflect changes to our Services or legal requirements. We will post the updated Terms with an effective date and, where required by law, provide advance notice or request consent. Continued use after the effective date constitutes acceptance of the updated Terms.

2. License and Restrictions

We grant you a limited, non-exclusive, revocable, and non-transferable license to use the Game for personal entertainment purposes. This license does not grant ownership rights in the Game, and all rights not expressly granted herein are reserved by Getcovers OÜ. You may not use the Game for commercial purposes without our written permission, modify, copy, distribute, publicly perform, or exploit any content within the Game, create derivative works based on the Game, use cheats, bots, hacks, or third-party software to manipulate gameplay, attempt to disrupt or interfere with the Game’s servers, mechanics, or security, attempt to reverse engineer, decompile, or extract source code from the Game, engage in fraudulent activities, including unauthorized transactions or identity impersonation, or violate any applicable laws or these Terms. Any violation of these Terms may result in account suspension or termination at our discretion.

3. User Conduct & Responsibility

You are responsible for all activities within your account. You must respect other players and refrain from offensive, harmful, or discriminatory behavior, avoid using offensive or inappropriate content in usernames, avatars, or player interactions, follow all applicable laws while using the Game, and report any misuse or inappropriate content through in-game reporting mechanisms. The Game may include interactive features such as stickers, leaderboards, and social interactions. You acknowledge and agree that you are solely responsible for your interactions with other players, we may monitor, moderate, or remove inappropriate content at our discretion, we do not take responsibility for user-generated content or actions of other players, and if you engage in behavior that violates these Terms, your account may be restricted or terminated.

4. Privacy

Please refer to our Privacy Policy to understand what information we process, how we use it, and what choices you have when you use our Services. You consent to us using your personal data as described in our Privacy Policy except where laws require us to obtain your consent in a different way. If you do not agree with our data practices, you should discontinue use of the Game and related services.

5. Age Restrictions and Limited Features for Minors

To ensure a safe gaming environment, additional restrictions apply to users under 18 (or under the age of majority in their jurisdiction). Users under 18 cannot log in through Facebook or other social platforms. They may only use in-game avatars and cannot upload custom profile pictures. Underage users must use a default assigned username with no option to edit it. Minors cannot use the sticker-based interaction system with real players; their interactions will be simulated. If we determine that an underage user has bypassed these restrictions, we reserve the right to suspend their account.
If you are under 18 years of age (or the age of majority in your jurisdiction), you must ask your parent or legal guardian to read these Terms and agree to them because you are not allowed to use our Services without their permission. If you are the parent or legal guardian of a minor who wants to use our Services and you permit them to do so, you agree to: (i) familiarize yourself with any parental controls that we offer in our Services and use them as you feel is appropriate; (ii) supervise the minor’s use of our Services; (iii) protect the minor from using our Services in a manner that may result in any negative consequences, such as by setting appropriate time limits on how long they may use our Services; (iv) ensure that your child only uses our Services in compliance with these Terms; and (v) be legally responsible for any actions or omissions of you or your child in connection with your or their use of our Services.

6. Virtual Items & In-Game Purchases

The Game may offer virtual currency, in-game items, and other digital goods for purchase. By making a purchase, you acknowledge that all purchases are final and non-refundable, except where required by law. Virtual items have no real-world value and cannot be exchanged outside the Game. We may modify or remove virtual items at any time without compensation. Unauthorized transactions (including account sharing or selling) are prohibited. If your account is suspended or terminated for violating these Terms, you will not be entitled to a refund for unused virtual currency or purchased content.

7. Refund Policy

Refunds are granted only in cases where required by law or at our sole discretion. If you share your account or payment details with others, engage in policy violations, or fail to secure your account, we are generally unable to provide refunds. Refund requests must comply with the terms of the respective payment processor. Taxes charged on purchases are non-refundable.
For purchases made via Google Play, refund requests can be submitted within 48 hours through the Google Play refund system. If the refund period has expired or if you experience issues with in-game purchases not being delivered, please contact our support team.
For purchases made via the App Store, refund requests must be submitted through Apple at https://reportaproblem.apple.com. Apple determines eligibility based on its policies and may deny requests in cases of suspected fraud, abuse, or manipulative behavior.
For purchases made on other platforms, including web-based transactions, refund requests should be directed to our support team at support@calmi.io. We will review such requests on a case-by-case basis, but we do not guarantee refunds unless legally required.
We reserve the right to decline refund requests for any digital goods, including virtual currency and in-game items, as all purchases are final. Refunds will not be issued for changes, updates, or the removal of digital content within the Game.

8. Online Purchasing and In-Game Currencies

When conducting online purchases, you must provide true, accurate, and complete information and use a non-fraudulent means of payment. If we suspect fraudulent activity, we reserve the right to void transactions, revoke associated licenses, and report the incident to relevant authorities. The Game includes Virtual Currency, such as coins and tokens, which can be used to acquire Virtual Items. Virtual Currency cannot be exchanged for real money, goods, or services outside the Game. We reserve the right to regulate, modify, or eliminate Virtual Currency and Virtual Items at our discretion, and we are under no obligation to compensate players for any resulting losses.

9. Copyright and Intellectual Property

All content within the Game, including software, text, graphics, and logos, is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without prior written consent. Any unauthorized use of our intellectual property is strictly prohibited. If you are deemed to have retained any rights in content, you agree to assign them exclusively to Getcovers OÜ. Some visual content in the Game has been generated using AI technology. Getcovers OÜ retains rights to AI-generated content in accordance with the terms of the respective AI service providers. We respect intellectual property rights and ensure that AI-generated content was not created using prompts intended to replicate the style of specific artists or companies. 10. Warranty Disclaimer and Limitation of Liability

The Game and all related services are provided “as is” and “as available” without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, title, and non-infringement). We do not warrant that the Game will be uninterrupted or error-free.

Limitation. To the maximum extent permitted by law, Getcovers OÜ and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or exemplary damages (including lost profits or data). Our total liability for any claims will not exceed the greater of the amount you paid to us in the six (6) months preceding the claim. Nothing limits liability for fraud, willful misconduct, or death/personal injury caused by negligence, or any liability that cannot be limited by law. Your statutory consumer rights remain unaffected.

Apple language. To the maximum extent permitted by law, Apple has no warranty obligations with respect to the Game and is not responsible for addressing any claims you or a third party may have relating to the Game or your possession/use of it. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Governing Law

These Terms are governed by the laws of Estonia. If any provision is deemed unenforceable, the remaining terms shall remain in full effect.

Statement from CALMI — Published May 1, 2025

As of May 1, 2025, prior to the release of any games by CALMI, we hereby affirm our commitment to supporting designers, artists, and the wider creative community. Creativity, authenticity, and respect for artistic work are core values of our company.

1. 90% of the artwork in our games has been created by our in-house designers and freelance contractors. We believe in fostering and showcasing human talent as a key part of our creative identity.
2. We deeply respect human creativity and have made it a priority to gradually replace any AI-generated art with artwork created entirely by our artists. We are fully committed to achieving a 100% human-made art pipeline across all our games.
3. When using AI tools during the early stages of development, we strictly avoided any prompts that would replicate, imitate, or infringe upon the styles, intellectual property, or rights of any artists, designers, or studios. We uphold the highest ethical standards in this regard.
4. All AI-generated content was based solely on the internal art direction of our games, without borrowing from or referencing third-party works.

Furthermore, CALMI believes that technology should empower, not replace, human creativity. We continue to invest in the professional growth of our artists, and we see AI only as a tool for assisting conceptual exploration, never as a replacement for genuine artistic expression.
